The following license agreement is for the OPC Data Control ActiveX Runtime Free version, which is our most popular license.

By opening this package or clicking the OK button during product installation when this license is displayed, you indicate that you have read this agreement and accept its terms and conditions. This is a legal agreement between you (the end user) and Software Toolbox (Matthews, NC). If you do not agree to the terms of this Agreement, promptly return the disk package and accompanying items (including written materials) to the place where you obtained them for a full refund.

1. GRANT OF LICENSE.  The software programs and other materials in this package are provided to you under the terms of this license agreement and are not sold to you. You own the media on which the software is recorded, but Software Toolbox retains copyright, title, and ownership of the software itself.

2. COPY RESTRICTIONS.  The development license for this ActiveX Software may be installed on a maximum of ONE (1) computer at any given time. Installation on additional computers requires the purchase of an additional developers license, item #41276103, from Software Toolbox Inc. You may, however, make one (1) backup copy for archival purposes.

3. RUNTIME CONTROLS. The runtime mode of the ActiveX controls may be installed on any number of computers ONLY if you have purchased the Runtime Free License of the OPC Data ActiveX control, item #41276102. If you have purchased item #41276101 then you do NOT have runtime distribution rights for this product.

4. UPDATE POLICY. Software Toolbox may create, from time to time, updated versions of the software. However, Software Toolbox is under no obligation to provide updates free of charge.

5. PRODUCT SUPPORT. Product Support is defined as questions, problems that are reasonably directly related to the advertised functionality of this Software product. Product Support does NOT include debugging, fixing, or writing computer code that is specific to your application. Software Toolbox Inc. provides e-mail Product Support for this Software whether it is a demo or registered license. Software Toolbox Inc. will provide a total of two hours free phone Product Support for all registered Software after paying the applicable license fees. Software Toolbox Inc. will provide phone support so long as you have paid Software Toolbox Inc. any applicable maintenance or support fees and subject to the terms of those agreements. All corrections and maintenance releases will be made available through Software Toolbox Inc.'s Internet site. All major product releases of the Software are subject to upgrade fees. At no time will on-site Product Support be provided without advance payment to Software Toolbox Inc. for a minimum of two days on-site engineering support services, plus all expenses.  Non-Product Support is available on a first-come first served, resource available basis, upon payment of currently published support fees.

6. WARRANTY.  Software Toolbox warrants you that the diskette(s) in this package will be free from defects in materials and workmanship for 60 days from the date of delivery to you.

7. LIMITATION OF WARRANTIES AND LIABILITY. Except for the express warranty above, Software Toolbox makes no other warranties with respect to this software, and is provided on an "as is" basis, without warranties or conditions, express or implied. The maximum liability assumed by Software Toolbox is the purchase price of this software. In no event shall Software Toolbox be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of or inability to use this software, even if Software Toolbox has been advised of the possibility of such damages.
